2. Starting a project
An inquiry is not a purchase or an authorization to start paid
work. Before a project starts, we agree in writing on the scope, fee, provider
and approval process. The accepted proposal, service agreement and approved
changes govern paid work and take precedence over conflicting general website
copy. This website does not automatically amend existing agreements.
3. Scope and approvals
An authorized client contact provides project instructions and
approvals. Clients supply accurate information and review content, details and
proofs before release. New pages, functions, campaigns or other work outside
the agreed scope require approval of any added cost and timing. Delays in
materials, access or approvals may affect delivery. Project-specific approval
requirements belong in the agreement.
4. Fees, outside costs and payment
Fees, deposits, due dates, approved expenses and payment methods
are set out before commitment in the project documents. Advertising spend,
subscriptions, licenses, printing and other outside costs are included only if
stated. A payer must be authorized to use the payment account. Authorization
must cover the stated charge; supplying payment details is not permission for
unrelated work or recurring payments.
5. Recurring services and cancellation
A recurring plan must specify the billing entity, service
period, price, renewal arrangement, cancellation method and any refund terms.
Automatic payment requires separate agreed authorization. To cancel or pause,
use the route in your agreement or contact your named billing provider in
writing. Completed work, approved outside costs, refunds, transition assistance
and service end dates are handled under that agreement and applicable law.
6. Client materials and deliverables
You retain the rights you already hold in materials you supply
and are responsible for having permission to use them. Ownership or licenses
for final deliverables, editable source files and reusable tools must be stated
in the written agreement. Stock imagery, fonts, software and other third-party
materials remain subject to their own licenses. Payment alone does not promise
ownership of every component or working file.
7. Portfolio and website materials
Website text, designs, portfolio examples, images and marks
belong to their respective owners. You may view the site and share links, but
may not reuse protected material without permission, except where law allows.
Portfolio examples may show earlier work or versions; inclusion does not by
itself represent a current client relationship or endorsement.
8. Website care and outside services
Your care agreement defines hosting, updates, domain services,
backup coverage, retention, recovery and response arrangements. This website
does not promise continuous live staffing, unlimited changes, zero downtime or
guaranteed recovery. Search engines, advertising platforms, payment systems and
other outside services apply their own terms and may change. Any express
service commitments in your agreement still apply.
9. Acceptable use
Use this site lawfully. Do not submit malware, impersonate
someone, misuse forms, infringe rights, attempt unauthorized access or
interfere with operation. We may block abusive activity without restricting
lawful rights.
10. Information, outcomes and legal rights
General information here is provided “as is” and may change. To
the extent permitted by law, no warranty is made about the website’s accuracy,
availability or fitness for a particular purpose. No specific search ranking,
traffic, sales, revenue or AI outcome is guaranteed. Nothing here excludes
liability or rights that cannot lawfully be excluded, or overrides an express
commitment in your accepted service agreement.
11. Privacy and communications
The Privacy Policy describes collection and use of personal
information, cookies and relevant service providers. Do not send passwords,
payment card details or sensitive records through the general inquiry form. An
inquiry allows us to respond about that inquiry; it does not enroll you in
marketing emails, automated calls or text campaigns. Any promotional opt-in is
requested separately.
12. Updates and questions
Updates apply from the published effective date, subject to any
notice or consent required by law. They do not change previously agreed
paid-service terms without the required agreement. Questions about this website
may be sent to xclaimagency@gmail.com or through Contact. For project, payment
or cancellation questions, use the contact shown on the applicable agreement or
invoice.
